Suspension or Cancellation of an FSSAI Licence: What to Do
After suspension or cancellation, read the actual grounds and restrictions, preserve the service date and assess the correct restoration or appeal route. The 2026 validity amendment also provides deemed suspension for relevant fee or return defaults. Food business must not continue during suspension under that framework.

Identify the type and basis
Distinguish a portal default status, authority suspension order, cancellation and surrendered authorisation. Keep the certificate, communication and account history. Different grounds require different evidence and cannot be resolved through one generic renewal payment.
Check fee or return defaults
The March 2026 amendment links annual-fee and applicable-return failures to deemed suspension and provides revocation after outstanding obligations and due penalties are resolved. Confirm the actual account position and restoration evidence before resuming. Read the amended provision.
Review authority orders separately
Section 32 addresses suspension, continued failure, cancellation and the public-health provision. Read the order and any show-cause or improvement history. Correcting one observation does not necessarily resolve every ground. Read section 32.
Protect appeal timing
The Act provides the stated appeal framework to the Commissioner of Food Safety, including fifteen days from service and the relevant improvement-notice earlier-expiry rule. Obtain advice on the actual decision and procedure. A pending appeal should not be assumed to create automatic permission to continue operating.
Document corrective action and the final position
Prepare point-by-point evidence, truthful CAPA and submission records. Verify the authority or system’s actual restoration decision and scope. Do not obtain a duplicate Tatkal authorisation to bypass an exclusion or hide an unresolved order. Read instant-issuance exclusions.
A worked example
Hypothetical example
A manufacturer’s account shows suspension linked to an applicable-return default. It checks the outstanding period, completes the required obligations and verifies the recorded restoration before resuming. Its payment receipt alone is not treated as proof that every restriction has ended.
